TERMS OF SERVICE

OVERVIEW Welcome to Odacieuse. The terms “we”, “us” and “our” refer to Odacieuse Lda. Odacieuse Lda operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence. You represent and warrant that all the information you provide is correct, current and complete. You are solely responsible for maintaining the security of your account credentials.

SECTION 2 - OUR PRODUCTS (SECOND-HAND NATURE) Odacieuse specializes in second-hand and consignment items. While we make every effort to display as accurately as possible the colors and images of our products, we cannot guarantee that your computer monitor's display of any color will be accurate. All items are sold in "Excellent Condition" but remain pre-owned. Descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

 

SECTION 3 - ORDERS AND CANCELLATIONS We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we will notify you by contacting the e‑mail and/or billing address/phone number provided. Returns & Exchanges: Your purchases are subject to return or exchange strictly in accordance with our [Refund Policy], which complies with the 14-day withdrawal right established by Portuguese Decree-Law no. 24/2014 for distance selling.

 

SECTION 4 - PRICES AND BILLING Prices for our products are subject to change without notice. Unless otherwise stated, prices are in Euros (€) and include VAT (IVA) at the applicable Portuguese rate. You agree to provide current, complete, and accurate purchase and account information. You represent and warrant that you are authorized to use the payment method provided.

SECTION 5 - SHIPPING AND DELIVERY We process and dispatch orders within 2 business days. While we aim for timely delivery, we are not liable for delays caused by shipping carriers or customs processing. According to Portuguese consumer law, the risk of loss or damage to the goods passes to you when you, or a third party indicated by you, acquires physical possession of the goods.

SECTION 6 - INTELLECTUAL PROPERTY All content included in the Services, such as text, graphics, logos, and images, is the property of Odacieuse Lda or its content suppliers and is protected by Portuguese and International intellectual property laws. Any unauthorized use of the materials appearing on this site may violate copyright, trademark, and other applicable laws.

SECTION 7 - THIRD-PARTY LINKS & TOOLS We may provide you with access to third-party tools (like payment gateways) or links to third-party websites. We have no control over these and provide them "as is" without any warranty. Any use of optional tools or third-party links is entirely at your own risk.

SECTION 8 - RELATIONSHIP WITH SHOPIFY Odacieuse is powered by Shopify. You acknowledge and agree that Shopify is a service provider and is not responsible for any aspect of the sales contract between you and Odacieuse Lda.

SECTION 9 - ERRORS AND OMISSIONS Occasionally there may be information on our site that contains typographical errors or inaccuracies related to product descriptions, pricing, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 10 - PROHIBITED USES You are prohibited from using the site or its content for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, or to violate any international or national regulations, including Portuguese laws.

SECTION 11 - LIMITATION OF LIABILITY To the fullest extent permitted by Portuguese law, Odacieuse Lda shall not be liable for any injury, loss, claim, or any direct, indirect, or consequential damages of any kind arising from your use of the service or any products procured. Nothing in these terms excludes our liability for gross negligence, fraud, or personal injury where such exclusion is prohibited by law.

SECTION 12 - SEVERABILITY & TERMINATION In the event that any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

SECTION 13 - GOVERNING LAW & JURISDICTION These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the Laws of Portugal. You and Odacieuse Lda agree that the Courts of Lisbon, Portugal shall have exclusive jurisdiction to settle any dispute.

SECTION 14 - CONSUMER INFORMATION & DISPUTE RESOLUTION In compliance with Law no. 144/2015, we inform you that in the event of a dispute, you may resort to an Alternative Dispute Resolution entity:
